Extend I-94 for a G5 Visa Holder (Domestic Employee)

Summary

This checklist summarizes the steps involved in extending the I-94 of a G5 visa holder, who is a domestic employee.

Note:

The I-94 of a G5 visa holder is marked with an expiry date. If the G5 visa holder leaves the U.S. before the expiry date of the I-94, then extending the I-94 is not required. The G5 visa holder will have to surrender his/her I-94 upon leaving the U.S. S/he will receive a new I-94, which will have a new expiry date, upon legal re-entry to the U.S.

Attention:

We have been informed by the State Department regarding a change in regulation for extending I-94 expiration dates for G5 domestic employees inside the U.S.

Only those domestic employees whose current G5 visa is annotated with the current employer¡¯s name can have the I-94 extended. Otherwise, the G5 domestic employee will have to leave the U.S. before the expiration date and renew his/her G5 visa abroad per the Request G5 Visa for a Prospective Domestic Employee Residing Outside the U.S. checklist.

S/he will receive a new I-94 with a new expiration date on re-entry to the U.S.

Request an extension of the I-94 for the G5 visa holder through and print the confirmation pages.

This should be done 30 calendar days prior to the expiry date of the I-94.

Note:

Processing time for an extension of a G5 visa holder's I-94 is about eight weeks.

G4 and G5 visa holders should have a U.S State Department issued Personal Identification Number (PID) before HR Operations can initiate extension of the I-94. PIDs are assigned through the State Department registration process. Most staff and many G5 visa holders are already registered. You can check the details in .

If you or your G5 visa holder is not registered, HR will initiate the PID registration prior to requesting the I-94 extension. This registration process can take three to four weeks. Once the PID number is issued, HR will proceed with the I-94 extension request.

Approach HR Operations in person and submit these documents:

  • G5 visa holder¡¯s passport, valid for no less than two years, with expiring I-94.
  • Copy of the staff member's passport information page, G4 visa, and
  • A copy of the valid, signed G5 contract in English ¨C . Include a copy of the identical non-English contract if you have executed one. This includes , , and versions.
  • U.S. Citizenship and Immigration Service (USCIS)

Attention:

Ensure that the G5 visa holder signs page three of the form in two places. Otherwise, the State Department will return the entire application.

Complete and retain .

Do not file this form with USCIS. It should be retained by you either for three years after the date of hire or for one year after employment is terminated, whichever is later. The form should be available for inspection by authorized U.S. government officials such as the Department of Homeland Security or the Department of Labor
